Notice of Non-Discrimination

NYOS Charter School does not discriminate on the basis of sex in its education programs or activities and is required by Title IX of the Education Amendments of 1972 (“Title IX”) and its implementing regulations not to discriminate in such a manner. The requirement not to discriminate extends to admission and employment.

Inquiries about the application of Title IX may be referred to the NYOS Charter School Title IX Coordinator, the U.S. Department of Education’s Office for Civil Rights, or both.

The Title IX Coordinator is responsible for coordinating NYOS Charter School’s compliance with Title IX, including oversight of reports and complaints of sex discrimination and sexual harassment.


Scope of Title IX

Title IX protects students, employees, and applicants from discrimination on the basis of sex, including sexual harassment, sexual assault, dating violence, domestic violence, and stalking, in NYOS Charter School’s education programs and activities.


Reporting Sex Discrimination or Sexual Harassment

Any person may report sex discrimination or sexual harassment at any time, including during non-business hours, by contacting the Title IX Coordinator using the information above.

Reports may be made by:

  • Email

  • Phone

  • In person

  • Any other method designated by the school

A report does not require the filing of a formal complaint and may be made by the person affected or by a third party.


Confidentiality

NYOS Charter School will respect the privacy of all parties involved to the extent possible. Information will be shared only with individuals who need to know in order to respond appropriately. Requests for confidentiality will be evaluated consistent with the school’s obligation to provide a safe and nondiscriminatory environment.


Supportive Measures

NYOS Charter School offers supportive measures to complainants and respondents designed to restore or preserve equal access to the school’s education programs and activities. Supportive measures may include, but are not limited to:

  • Academic accommodations

  • Schedule modifications

  • Counseling referrals

  • Safety planning

Supportive measures are available regardless of whether a formal Title IX complaint is filed and are provided at no cost to the individual.


Formal Grievance Process

When a formal complaint is filed, NYOS Charter School will follow a fair and impartial grievance process which is outlined in our NYOS Grievance Procedures page.


Appeals

Both parties have the right to appeal the determination or dismissal of a formal complaint on permitted grounds, such as:

  • Procedural irregularity

  • New evidence

  • Conflict of interest or bias

Appeal procedures and timelines will be provided in writing with the determination.


Prohibition of Retaliation

Retaliation against any individual for reporting sex discrimination or harassment, participating in an investigation, or exercising rights under Title IX is strictly prohibited. Allegations of retaliation will be addressed promptly.


External Reporting Option

Individuals may also file a complaint with the U.S. Department of Education, Office for Civil Rights (OCR).


Training & Fairness

All Title IX personnel involved in reports, investigations, and adjudications receive appropriate training and act without conflicts of interest or bias for or against complainants or respondents.
